Exporting to or importing from China involves three overlapping risk layers that operate independently: Section 301 tariffs reaching 145% on select HTS codes, Bureau of Industry and Security licensing requirements for controlled technology, and OFAC sanctions on designated entities and individuals. Since 2020, Hong Kong is no longer treated as a separate export destination under US law. SMB exporters dealing with Chinese partners, distributors, or manufacturers need to screen against the BIS Entity List, Unverified List, and OFAC SDN List before every transaction — not just at onboarding.
